Q. Can I get extension on my court case?
A: Generally it is difficult to get an extension on a court.
The court calendar is very congested. If you have already been
arraigned and need an extension on a status check court date
it may be possible to make arrangements for a continuance. However,
this is handled on a case by case system and normally the Judge
has to grant the extension. If you need an extension you may
enquire about it by calling us to determine if USJA can handle
it for you. Please see our Contact Us page.
Q: If I complete the counseling program,
will I have anything on my criminal record?
A: Generally, if you were given counseling as the only
requirement of the court, the Judge will dismiss the charges
against you. Your criminal record will show that a citation/arrest
was given or made; however, your criminal record will show that
the case was ultimately dismissed and employers should not be
able to use this against you. If you were given counseling as
part of a plea bargain to reduce your charges than what ever
your charges were reduced to by the court will be what shows
on your criminal record.
Q: Can I have my records sealed?
A: If you only have misdemeanors on your record, you can have
your records sealed so that NOTHING shows on your criminal record.
You must wait 30 day after your case is closed. This process
can be handled on your own, however it is a lot of work and
forms must be filed with the state. There are many Attorneys
that can handle this for you, which will save you a lot of time
and frustration, and insure that it gets done right. Please
see our Legal Problems page to find a list of attorneys
that we recommend and that will get the job done right for your
piece of mind. (All Attorneys have their own fee schedules for
their services. We encourage you to shop around.)
Q: Can I get my materials or complete them
online while I am making payments?
A: Generally the answer is no. The program must be paid for
in full in advance of receiving the materials on line or in
the mail. Rare exceptions can be arranged by your Judge.
Q: Do I have to return to court if I have
completed my counseling requirements?
A: It is always safest to return to court to hear your case
dismissed. However, if counseling was your only court requirement
and you successfully completed it and have your Certificate
of Completion your presence is not necessary. However,
if you had any other requirements such as restitution or community
service, you are required to be back in court unless you are
sure that the court has proof of your compliance with those
conditions.
Q: What happens if I do not have my "Certificate
of Completion" before my return court date?
A: You may contact us and inquire about your recorded status
and to find out if it is necessary for you to return to court.
